Overview of Article 49 of the Constitution of Pakistan

The Constitution of Pakistan, adopted in 1973, is the guiding legal document that shapes the nation’s governance, principles, and rights. Within this constitutional framework, Article 49 holds a pivotal role, addressing the continuity of executive authority when the President cannot carry out their duties. In this blog post, we embark on a journey to explore Article 49 and its implications in Pakistan’s governance structure.

Article 49 States

49. Chairman or Speaker to act as, or perform functions of, President.

(1). If the office of President becomes vacant by reason of death, resignation or removal of the President the Chairman or, if he is unable to perform the functions of the office of President, the Speaker of the National Assembly shall act as President until a President is elected in accordance with clause (3) of Article 41.

(2). When the President, by reason of absence from Pakistan or any other cause, is unable to perform his functions, the Chairman or, if he too is absent or unable to perform the functions of the office of President, the Speaker of the National Assembly shall perform the functions of President until the President returns to Pakistan or, as the case may be, resumes his functions.

This section specifies that in case the President’s office becomes vacant due to death, resignation, or removal, the Chairman of the Senate (Chairman) will temporarily assume the role of the President. If the Chairman is unable to perform the President’s functions, the Speaker of the National Assembly will act as President until a new President is elected in accordance with Article 41.

This subsection addresses situations in which the President is temporarily unable to carry out their duties due to their absence from Pakistan or another reason. If this occurs, either the Chairman (if absent himself) or if both cannot perform them – Speaker of the National Assembly – will act as President until either they return home or are capable of taking back up their functions again.
